1. Agreement to Terms

By accessing or using BOOKIP (“the Service”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users, including hotel owners, administrators, and staff members.

2. Description of Service

BOOKIP is a hotel and room management system that enables property owners to manage rooms, bookings, guest records, rates, and hotel operations through a web-based platform. The Service is provided on a subscription basis with free and paid plans as described on our Pricing page.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring that your account information is kept up to date

We reserve the right to suspend or terminate accounts that contain false information or are used in violation of these Terms.

4. Subscriptions & Billing

BOOKIP offers free and paid subscription plans. By selecting a paid plan, you agree to the following:

• Billing cycles: Subscriptions are billed monthly or annually depending on your selected plan.
• Automatic renewal: Paid plans automatically renew at the end of each billing period unless cancelled before the renewal date.
• Price changes: We may adjust pricing with at least 30 days' written notice. Existing subscribers will be notified by email.
• Taxes: All prices are exclusive of applicable taxes, which may be added at checkout.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable local, national, or international law or regulation
• Upload, transmit, or store any data that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Attempt to gain unauthorized access to other accounts, systems, or networks connected to the Service
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure
• Use the Service for any fraudulent or misleading purpose
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell, sublicense, or redistribute access to the Service without written consent

6. Data & Privacy

You retain ownership of all data you enter into the Service, including hotel information, room configurations, guest records, and booking data (“Your Data”). By using the Service, you grant BOOKIP a limited license to process Your Data solely for the purpose of providing and improving the Service.

7. Service Availability

We strive to maintain the Service at a high level of availability. However, the Service is provided “as is” and “as available.” We do not guarantee:

• Uninterrupted or error-free operation of the Service
• That defects will be corrected within a specific timeframe
• That the Service will meet your specific requirements

We may perform scheduled maintenance with advance notice. In the event of unplanned downtime, we will make reasonable efforts to restore the Service promptly.

8. Intellectual Property

The Service, including its design, code, features, documentation, logos, and branding, is the intellectual property of BOOKIP and is protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

9. Limitation of Liability

To the maximum extent permitted by law, BOOKIP and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or business opportunities
• Cost of procuring substitute services
• Damages arising from unauthorized access to or alteration of your data

Our total liability for any claim arising from the Service shall not exceed the amount you paid to BOOKIP in the twelve (12) months preceding the claim.

10. Termination

You may terminate your account at any time from your account settings. We may suspend or terminate your access to the Service at our discretion if:

• You breach any provision of these Terms
• Your account has been inactive for more than 12 consecutive months (free plan)
• We are required to do so by law
• We discontinue the Service (with at least 90 days' notice)

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including liability limitations, intellectual property, and dispute resolution) will remain in effect.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved through the courts of competent jurisdiction in the Philippines.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email and posted on this page with an updated date at least 30 days before taking effect. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
